Craft Labor Quality Assurance Agreement
This Craft Labor Quality Assurance Agreement ( the “Agreement”) is undertaken to promote the timely, efficient and successful delivery of the construction of the Expansion and Renovation of the Pennsylvania Convention Center, the Agreement is entered with the Pennsylvania Convention Center Authority and all general contractors, prime contractors and subcontractors of any tier used to perform Covered Work on this Project (“Project Contractors”), and the Building and Construction Trades Council of Philadelphia and Vicinity (“Philadelphia Building Trades” or “Trades Council”) on behalf of itself and the affiliated Local Unions of the Council (hereinafter “Local Unions”) that signed the Agreement:
Monitoring and Reporting
The PCCA and Greater Philadelphia Urban Affairs Coalition (“GPUAC”), shall be responsible for monitoring and reporting on the compliance of all the parties (including but not limited to contractors, labor organizations, AAPs, etc.) with the provisions of this Program. All such parties agree to provide their full cooperation to GPUAC with respect to such monitoring efforts. The parties further agree to periodically report, as GPUAC shall require, on the status of all their activities as are related to their compliance with the Program, and provide such information and documentation as GPUAC may request.
The Authority is committed to equal opportunity and access in its operations, programs and projects and prohibits discrimination in any manner against any employee or applicant for employment, training or services, on the basis of race, color, religion, gender/sex, national origin, ancestry, age, marital or veteran status, medical condition, disability, sexual orientation, citizenship, genetic information or any other status protected by the law.
The Authority desires to use the largest public works project in the City as an engine for new economic opportunity for employees, including minority persons and women who have not previously had access to such opportunities. The Authority has adopted its own workforce utilization goals for the Project, and they are: 40% minority (25% African-American; 10% Hispanic-American; and 5% Asian American) and 10% female, respectively. The Authority believes that, in the absence of discrimination, the best and good-faith efforts of the contractors, subcontractors, labor organizations and union apprenticeship training programs party to the CLQA (the “Parties”) to provide equal opportunity and access to minority and female workers will result in meaningful and substantial progress in the participation of minority and female workers on the Project.
Apprenticeship Goals
To make sure there are sufficient opportunities for individuals to benefit from the Program, the maximum number of apprentices permissible under the prevailing journeyman-to apprentice ratios must be utilized on the Project. Subject to applicable journeyman-to-apprentice ratios, a minimum goal of 25% of the total labor hours for the Project are to be performed by Apprentices. Further, a minimum goal of 50% of all apprentice hours on the Project (and to the extent practicable, 50% of all apprentice hours for each trade) must be performed by Apprentices who were referred to the union apprenticeship training programs and contractors by the Program. These requirements will be incorporated into each construction contract as well. The Program will give credit toward these goals in the event it determines that despite the full cooperation and best efforts of the parties, sufficient numbers of qualified Candidates are not available.
Philadelphia Resident Goals
With respect to the employment of local residents, the Parties will make best and good faith efforts to employ local residents in the construction workforce consistent with a workforce utilization goal of 50%. The Parties agree to take all lawful, available, positive and meaningful steps to maximize the inclusion of all qualified workers by assuring that qualified minority persons and females are aware of and have equal opportunity and access to employment and participation in apprenticeship training programs. Such efforts shall be documented and reported to the Authority as it may request. The Parties will assist and cooperate actively and fully with the Authority and the Greater Philadelphia Urban Affairs Coalition (“GPUAC”), which is responsible for monitoring and reporting on the compliance of all Parties with these Programs.
